“Ordered
by the Court that A.B. Faw, Pendleton Jones, and William Hunter be appointed
commissioners, together with Miller Special Surveyor, to allot, set apart and
lay off to the widow of John Neill, deceased, a dower in all the real estate of
which the said John Neill, deceased, seized and possessed and to that end that
the evidence of title held by the decedent giving a description of said land to
be exhibited to said commissioners and that in their report they will embody a
description of said land. Also that the commissioners and Special
Surveyor report their action to the next term of this court.”
“Presented
in open Court the report of the commissioners appointed to lay off to the widow
of John Neill, deceased, one year’s support which was received, examined and
confirmed by the court and ordered to be spread on record of the Will Book.”
“Presented
in open court by Benjamin M. Neill, Administrator of the Estate of John Neill,
deceased, a plot of the dower assigned to the widow of said deceased and report
of the surveyor and commissioners, which was examined, approved and confirmed
by the Court and ordered to be spread on record of the Will Book.”
“Presented
in open Court by Benjamin M. Neill, administrator of the Estate of John Neill,
deceased, an inventory of the personal property, notes and accounts belonging
to said Estate which was examined, approved and confirmed by the Court and
ordered to be spread on record of the Will Book. The Administrator would
further report that the intestate at his decease held a note of hand on A.B.
Faw for $150.00, given in 1863 and payable in currency and as said note was
given for a yoke of oxen at Confederate prices and inasmuch as it did not
appear certainly how much was justly due on the note, the same was referred to
Jacob Zodack and Thomas Mosely to arbitrate and determine what was due and they
awarded the Administrator a horse which Faw was offering in satisfaction of the
debt and which horse they considered of the value of $100.00 and the
Administrator took said horse for the foregoing reasons and in order to secure
the debt.
The
above report was examined, approved and confirmed by the Court.”

Notes
for LUCRETIA STACY:
Marriage
bond for Lucretia Stacy and John Neill was signed by John Neill and Joshua
Stacy. It was issued 1-02-1821 but also signed on the back and dated
1-02-1822. Not sure which year is correct but will assume 1822. The
bond was for the amount of 500 pounds, a substantial amount of money. The
copy of the bond I received from NC Archives and State Library is pretty poor
and has been partially burned or ripped and decayed.
Lucretia
was living with her son, Benjamin in Marshall Co., TN after the death of her
husband. She is listed on the 1880 census with his family. She
lists the place of birth of herself as North Carolina and her parents
birthplace as Maryland.
In
1875 and 1876, Lucretia was named with several of her siblings in a
probate suit. Her Brother Benjamin Stacy died and his administrator was
Isaac S. Stacy. Apparently Benjamin did not have enough cash to pay his
debts and charges of the administration. Isaac had to bring suit to have
Benjamin’s land and property sold to settle all the accounts. As
Lucretia, Oliver, Aaron Greene Stacy and Thomas B. Stacy were named in the suit
as they all would have inherited. They also had to give permission for
the land to be sold and they lived out of state. Lucretia was living in
Marshall county, TN and Aaron Greene and I believe Thomas lived in South
Carolina. I have copies of the petitions, obtained through North Carolina
archives. Many, many pages. This was settled in Superior Court of
Burke County (in Morgantown), North Carolina. Quite a big inventory of
property and the final settlement papers are included.

---
John Pope Love, judge of the probate court, was born in Knox Co., TN, July 28,
1828. His father, Thomas B. Love, was born in Chester Co., PA in 1794,
being the son of John Love, originally from Ireland, who went to East TN in an
early day. The mother of John P. was formerly Susan Smith of TN.
Her father was from England. Mrs. Love died in TN June 15, 1861, and her
husband died in 1874. They had seven children, of who J.P. is the second
child. He was reared on a farm. His early school training was somewhat
neglected, but through self-application he acquired a practical education and
attained a prominent social position. In 1850 he moved to Cherokee Co.,
NC where he farmed for 3 years. He then returned to TN, and in the spring
of 1858, came to Missouri and settled in St. Clair Co. and improved a
farm. In 1872 he was elected county judge. In 1876 he was elected
probate judge. He was re-elected in 1878, 1880 and in 1882, a sufficient
proof of his faithful service in that important office. Judge Love was
married in 1848 to Miss Elizabeth C. Neill who was the daughter of John Neill
of Polk County, TN. She died in 1853, leaving three children. Mr. Love
married Narcissus (or Elizabeth) N. Barker in 1855, daughter of Burrell Barker
of McMinn Co., TN. They have family of twelve children. The judge
in his political affiliations is a Democrat, and he is a member of the Masonic
order. In June, 1861, he enlisted in the Missouri State Guard and served
eight months. He was in the engagements at Cathage, Springfield, Dry Wood
and Lexington. In 1862 he enlisted in the 16th Missouri Infantry, Colonel
Caldwell commanding, and was elected lieutenant and promoted to captain. He
served during the war, surrendering at Shreveport.

Notes
for JOHN R. NEILL, DR.:
Found
two articles in “The Courier Democrat” of Russellville, Arkansas
Dated
May 7, 1901, page 4, column 6 - last item in “Additional Local” column: “Pope
county friends of Dr. J.R. Neill will be pleased to learn that he is now a full
fledged M.D. having graduated in the study of medicine the 23rd of last
month. He is now located at Vian, I.T. (Oklahoma) and in directing us to
change the address of his paper to that place says; “Kindly remember me to my
friends in old Pope.”’ This article would have placed his
graduation at April 23, 1901
In
the American Medical Assoc.’s Directory of Deceased Physicians it shows that
Dr. Neill was a graduate of the Gate City Medical College in Dallas, TX in
1903. Actually the school was in Texarkana, both Arkansas and Texas in
its early years. It ceased to exist in 1911.

CHAPMAN May 21, 1923 in Hughes County, Oklahoma, daughter of GEORGE CHAPMAN and
MARY REED.
Notes
for CLAUD CICERO NEILL:
Claude
Neill Sr. was struck by a drunk driver on Route 99 around Bakersfield, CA and
was badly injured. He had to be put in a body cast for about a
year. He was transported to San Jose, CA by train where Maude and the
family lived and worked until he was recovered. In Spring of 1944 (Mar or
April), Claude purchased a 40 acre dairy farm in Los Banos, CA. It was 28
acres of permanent pasture, with the rest for barns, out bldgs., housing, etc.
He
sold the farm in 1945 as it proved to be too much work for him in his weakened
conditioned. The accident had left his legs severely weakened and he
always walked with a cane and very slowly. They moved to 415 Arletta Avenue,
in San Jose, CA.
Claude
Sr, Claude Jr. & Dean all bought brand new shotguns to go duck hunting with
in 1947 or 1948. They purchased them at the Farmers’ Union Hardware store
on San Pedro Street in San Jose, CA. Alan still owns his father’s Ithaca
model 1937 that was bought by his dad, Claude Jr.

Notes
for MAUDE ETHEL CHAPMAN:
Maude
was in a rest home in San Andreas, California when she passed away.
Unfortunately, Ed and Esther Crandall were on vacation in a motorhome in
Florida with no way to contact them. They were supposed to check in with
their children on occasion. Dean and Claude had to wait to make the
funeral arrangements until they could contact Ed and get his approval.
Alan and I just couldn’t believe that they could postpone the funeral that long
so Alan called Dean for a nightly update. Alan asked Dean just how long
they could postpone the funeral. Dean, in his usual quick humor, answered
“I guess as long as their freezer holds out.”
